Terms & Conditions

1. Agreement

These Terms & Conditions (“Terms”) govern your access to and use of the Won2Build Hub and its connected applications — Time Budge, Bid Track, CO Hub, and Takeoff — together with our websites and related services (collectively, the “Services”). By creating an account or using the Services, you agree to these Terms. If you are using Won2Build on behalf of an employer, you confirm you are authorized to bind that employer to these Terms.

2. Accounts

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

• Do not falsify time entries, bids, change orders, location data, or identity.
• Do not attempt to defeat geofencing, security, or access controls.
• Do not upload unlawful, harassing, or infringing content.
• Do not interfere with the Services, other users, or our infrastructure.
• Do not reverse engineer, copy, or resell the Services.
• Use the Services only for lawful, work-related purposes.

4. Employer relationship

If your employer provides you access to Won2Build, your employer controls the account, the data you submit, and how that data is used for payroll, project management, and workforce operations. Questions about your specific schedule, pay, or recorded hours should be directed to your employer.

5. Subscriptions, billing & trials

• Paid plans are billed by the employer account holder through Stripe, monthly in advance based on the plan and any per-worker fees.
• Free trials convert to paid subscriptions at the end of the trial unless cancelled.
• Fees are non-refundable except where required by law. You may cancel future renewals at any time from billing settings; access continues through the end of the current period.
• We may change pricing on at least 30 days’ notice. Changes apply to the next billing cycle.

6. Communications

By providing a phone number, you consent to receive transactional text messages (such as schedule reminders) related to your use of the Services. Standard message and data rates may apply. Reply STOP to opt out of SMS at any time.

7. Intellectual property

The Services, including software, design, and trademarks, are owned by Won2Build and its licensors and are protected by applicable laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

8. Your content

You retain ownership of any content (notes, photos, plans, time data, bids, change orders, takeoffs) you submit. You grant Won2Build a worldwide, royalty-free license to host, process, and display that content solely to operate and improve the Services for you and your employer.

9. Termination

We may suspend or terminate your access if you violate these Terms, if your employer’s subscription ends, or if continued provision becomes impractical or unlawful. You may stop using the Services at any time.

10. Disclaimers

The Services are provided “as is” and “as available.” Won2Build disclaims all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that GPS/location, estimate, or takeoff data will be accurate in every situation. Construction estimates, time entries, change orders, and other outputs are tools to support your decisions, not professional advice.

11. Limitation of liability

To the fullest extent permitted by law, Won2Build and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount paid by the relevant employer for the Services in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold Won2Build harmless from claims arising out of your misuse of the Services or violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in California, and you consent to their personal jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
